Who's side are you on?

In a world of frivolous lawsuits it can sometimes be difficult to distinguish between real issues and petty claims.

In this article, a man having allergic reactions to dairy products requested a major fast food restaurant to hold the cheese, but they didn't. So when he ate the burger in a darkened room he went into convulsions.

Now he is suing for 10 million on behalf of "two counts of negligence, one count of intentional infliction of emotional distress and one count of punitive damages."

Who's responsible?

Mickey D's is to blame. No doubt about it. So what if the guy has a serious food allergy and doesn't bother to take 2 seconds to check if there is the source of said allergy on his 99 cent hamburger? Bring on those punitives.

If you have life threatening allergies, you are nuts to put your life in the hands of minimum wage workers who regularly make human mistakes. Who hasn't had an order messed up? He should have visually examined his sandwich before leaving the restaurant. Anyone who is in the habit of making special orders or at least large orders knows to check to make sure it all is there and correct.

I'm sure the guy is telling himself on his "near" death bed that he should have checked the burger, but come on. If he really did tell the workers 5 times that he can't have cheese because of an allergy, is McDonalds not at least somewhat to blame? Punitives! Punitives!
